This webinar and workshop series is provided free of charge by the New York City Department of Mental Health & Hygiene.
This lecture will focus on the benefits of a Special Needs Trust when planning for the financial future of an individual with special needs. Topics to be covered will include a brief overview of the eligibility for various kinds of benefits individuals might be eligible for and the interrelationship between trusts and benefit eligibility as well as how and when to set up a special needs trust.
Event Objectives
1) Providing an understanding of the difference between different types of government benefits and when a special needs trust is necessary
2) Comparing establishing a trust during one’s lifetime versus in a will
3) Explaining the difference between funding a trust with the assets of family members versus the assets of the disabled individual which might include an inheritance or award from a lawsuit
4) The event will also include a brief overview of Guardianship in New York State and when special needs trusts are set up in a guardianship proceeding

Daniel Kuhn is a partner in the law firm of Kuhn O’Toole and Maietta. He has been practicing for over 25 years and his specialties include Trusts and Estates with particular expertise in special needs planning. He holds both a Juris Doctor and Master in Social Work from the University at Buffalo.
